M. JUNAEDI HADIRKAN 1 SAKSI TAMBAHAN DI SIDANG PAMUNGKAS PN PANDEGLANG
Tim Kuasa Hukum dari Kantor Hukum M. Junaedi & Rekan (MJA Law Office) mewakili Ny. Rustini Bardiyan selaku Tergugat I, PT Rajuli Setia selaku Tergugat II dan PT Pulau Kelapa Carita selaku Turut Tergugat II telah menghadiri sidang Kesaksian dalam perkara No.: 26/Pdt.G/2019/PN.Pdl pada hari Kamis, tgl 5 Maret 2020. Dalam persidangan kesaksian ini, Tim Kantor Hukum M. Junaedi & Rekan (MJA Law Office) menghadirkan 1 orang saksi tambahan yakni Bapak Asep Desi Susanto, S.Sos selaku Kasubid Penilaian dan Pengaduan Badan Pelayanan Pajak Daerah Kabupaten Pandeglang.
Dalam kesaksiannya Asep menerangkan bahwa proses balik nama pada SPPT PBB dari atas nama Ny Rustini Bardiyan ke Patmadipura kurang sempurna karena tidak ada persetujuan dari Ny. Rustini Bardiyan dan Ketika ditanya oleh M. Junaedi “Apakah Suadara Saksi mengetahui bahwa Patmadipura sudah meninggal dunia pada tahun 1996? Ybs menjawab tidak tahu.“
Dalam kesempatan sidang ini, Ketua Majelis memberikan nasehat penting kepada BP2D Pandeglang supaya ke depan tidak begitu mudah untuk menerbitkan Subjek Pajak pada SPPT PBB. Majelis Hakim meminta para pihak untuk menyerahkan KESIMPULAN pada sidang hari Kamis, tanggal 12 Maret 2020.
Adapun, advokat yang hadir mewakili Kantor Hukum MJA adalah Adv. M. Junaedi, A.Md., S.H., CIL., sementara tim advokat lain punya kesibukan masing-masing. Turut hadir di persidangan Ny. Junaedi & Associates (MJA Law Office) represented Mrs. Rustini Bardiyan as Defendant I, PT Rajuli Setia as Defendant II and PT Pulau Kelapa Carita as Co-Defendants II attended the Testimony hearing in case No. 26 / Pdt.G / 2019 / PN.Pdl on Thursday, March 5, 2020. In the trial of this testimony, the Law Office Team of M. Junaedi & Associates (MJA Law Office) presented 1 additional witness, namely Mr. Asep Desi Susanto, S. Sos as the Head of Appraisal and Complaints of the Regional Tax Service Board of Pandeglang Regency.
In his testimony, Asep explained that the process of changing the name of the SPPT PBB form from the name of Mrs. Rustini Bardiyan to Patmadipura was less than perfect because there was no agreement from Ny. Rustini Bardiyan and when asked by M. Junaedi “Did you notice that Patmadipura had died in 1996? He said he did not know. ”
On the occasion of this session, the Chairperson of the Assembly gave important advice to BP2D Pandeglang so that in the future it would not be so easy to issue a Tax Subject on the SPPT PBB. The Panel of Judges asked the parties to submit CONCLUSIONS at the hearing on Thursday, March 12, 2020.
