PUTUSAN 5813 PA BANDUNG MENGUSIK RASA KEADILAN MASYARAKAT

Sidang Putusan Perkara No. 5813/Pdt.G/2019/PA. Bandung berpihak kepada Pemohon Yang Notabene Non Muslim

M. Junaedi selaku Ketua Tim Kuasa Hukum yang bertindak untuk dan atas nama serta mewakili Sdri. Dewi Sartika selaku Termohon 2, yang dimohonkan oleh Sdri. Agustina Tri Rahayu Binti AG Slamet selaku istri pertama Sdr. Anjas Suryo yang beragama Katholik yang tinggal di Lampung Tengah, yang telah mengajukannya ke PA Bandung dengan tanggal gugatan 25 November 2019 dan diterima di PA Bandung dengan register no. 5813/Pdt.G/2019/Badg tertanggal 2 Desember 2019 terkait permohonan pembatalan perkawinan antara Sdr. Anjas Suryo dan Sdri. Dewi Sartika.

Sidang putusan ini digelar pada hari Senin, tanggal 27 April 2020, yang dihadiri oleh Kuasa Pemohon, Sdr. Ade Sofian, S.H.I, Sdr. Anjas Suryo selaku Termohon 1, M. Junaedi, A.Md., S.H., CIL selaku Ketua Tim Kuasa Hukum Termohon 2, Sdri. Dewi Sartika, serta Kepala KUA Kec. Bandung Kidul, Nu’man Kamil selaku Termohon 3.

Persidangan ini dipimpin oleh Ketua Majelis Hakim Haerudin dengan didampingi oleh dua anggota majelis yang sejatinya Ikhwan Sopiyan dan Muhadir. Akan tetapi pada setiap kali siding yang ada sebagai anggota majelis adalah hakim perempuan serta Panitera Pembantu yaitu Neng Endah.

Sejak awal, persidangan perkara ini diduga oleh M. Junaedi agak kurang pas, karena Ketua Majelis yang diduga terlalu memonopoli persidangan, tidak pernah kelihatan hakim anggota diberikan peranan untuk bicara ataupun menyumbangkan saran pemikiran. Dari A sampai Z selalu di Ketua Majelis yang berperan.

2. Menyatakan membatalkan perkawinan antara Termohon I Anjas Suryo alias Anjas Suro alias Petrus Suryo Handoko bin H. Sardi alias HY Sardi alias HP Sardi dengan Termohon II Dewi Sartika binti Sujana yang dilangsungkan di wilayah hukum Kantor Urusan Agama (KUA) Kecamatan Bandung Kidul Kota Bandung pada tanggal 17 Maret 2018 yang tercatat dengan tanggal 01 April 2018;
3. Menyatakan Kutipan Akta Nikah Nomor 0103/005/IV/2018 tertanggal 1 April 2018 yang dikeluarkan oleh Kantor Urusan Agama Kecamatan Bandung Kidul Kota Bandung dinyatakan tidak berkekuatan hukum dan batal demi hukum;
4. Menyatakan tidak menerima permohonan Pemohon selainnya;

•  Membebankan biaya perkara baik dalam konpensi maupun dalam rekonpensi kepada Pemohon Konpensi/Tergugat I Rekonpensi sejumlah Rp. 796.000,- (tujuh ratus sembilan puluh satu ribu rupiah);

Atas putusan ini, Sdri. Dewi Sartika memberikan waktu kepada Sdr. Anjas Suryo untuk berlaku bijak dan adil, serta ditunggu untuk memberikan jawaban sampai hari Rabu, tanggal 29 April 2020 pada jam 17.00 WIB. Bilamana tidak ada jawaban, maka Sdri. Dewi Sartika berpikir untuk mengajukan Banding, bila masih kurang puas di putusan Pengadilan Tinggi Agama Jawa Barat, maka akan menempuh Kasasi ke Mahkamah Agung RI, bila diperlukan mungkin Peninjauan Kembali (PK) ke Mahkamah Agung RI karena hal inilah telah mengusik rasa keadilan sebagai seorang muslimah.

Sungguh ada putusan yang diduga nyeleneh “Menyatakan Kutipan Akta Nikah Nomor 0103/005/IV/2018 tertanggal 1 April 2018 yang dikeluarkan oleh Kantor Urusan Agama Kecamatan Bandung Kidul Kota Bandung dinyatakan tidak berkekuatan hukum dan batal demi hukum”. Apakah ini artinya selama hampir 1 tahun 7 bulan lebih, hubungan senggama antara Sdr. Anjas Suryo dan Sdri. Dewi Sartika dianggap zinah?

Bahkan, diduga target Sdr. Anjas Suryo menikahi Sdri. Dewi Sartika adalah untuk mendapatkan KTP Elektronik dan Kartu Keluarga di Kota Bandung sudah tercapai untuk memuluskan bisnis dibidang alat-alat kesehatan.

Demikian putusan dari permohonan pembatalan perkawinan antara Sdr. Anjas Suryo dan Sdri. Dewi Sartika.

Judgment Case No. 5813 / Rev.G / 2019 / PA. Bandung is in favor of the Non-Muslim Applicant

1. Junaedi as Head of the Legal Counsel Team that acted for and on behalf of and represented Ms. Dewi Sartika as Respondent 2, requested by Ms. Agustina Tri Rahayu Binti AG Slamet as the first wife of Anjas Suryo who is a Catholic who lives in Central Lampung, who has submitted it to PA Bandung on the lawsuit date November 25, 2019 and received at PA Bandung with register no. 5813 / Pdt.G / 2019 / Badg dated December 2, 2019 regarding requests for a marriage cancellation between Anjas Suryo and Ms. Dewi Sartika.

The verdict hearing was held on Monday, April 27, 2020, which was attended by the Petitioner’s Attorney, Advocate Ade Sofian, S.H.I, Anjas Suryo as Respondent 1, M. Junaedi, A.Md., S.H., CIL as Head of the Respondent 2 Legal Counsel Team, Ms. Dewi Sartika, as well as the Head of KUA Kec. Bandung Kidul, Nu’man Kamil as Respondent 3.

The trial was presided over by Chair of the Panel of Judges Haerudin accompanied by two members of the panel who were actually Ikhwan Sopiyan and Muhadir. However, every time the session was held as a member of the panel, the female judge and the Assistant Registrar, Neng Endah.

From the beginning, the trial of this case was alleged by M. Junaedi to be somewhat inappropriate, because the Chairperson of the Assembly who was suspected of overly monopolizing the trial, it was never seen that member judges were given the role to speak or contribute ideas. From A to Z, the Chair of the Assembly is always in charge.

2. Declaring canceling the marriage between Respondent I Anjas Suryo alias Anjas Suro alias Petrus Suryo Handoko bin H. Sardi alias HY Sardi alias HP Sardi with Respondent II Dewi Sartika binti Sujana which was held in the jurisdiction of the Office of Religious Affairs (KUA) in Bandung Kidul District, Bandung City on March 17, 2018 which was registered on April 1, 2018;
3. Stating Quotation of Marriage Certificate Number 0103/005 / IV / 2018 dated April 1, 2018 issued by the Office of Religious Affairs in Bandung Kidul Sub-District, Bandung City, is declared as having no legal power and is null and void by law;
4. Declare not to accept the Petitioner’s request other than that;

• Imposing court fees both in the convention and in the reconvention for Applicants to the Conference / Defendant I for the Reconstruction amounting to Rp. 796,000 (seven hundred ninety-one thousand rupiah);

On this decision, Ms. Dewi Sartika gave time to Anjas Suryo to act wisely and fairly, and is expected to provide answers until Wednesday, April 29, 2020 at 17.00 WIB. When there is no answer, then Ms. Dewi Sartika thought to submit an appeal, if still not satisfied in the decision of the High Court of the Religion of West Java, it would take an appeal to the Supreme Court of the Republic of Indonesia.

There was indeed a verdict that was allegedly absent “Stating Quote Marriage Certificate No. 0103/005 / IV / 2018 dated April 1, 2018 issued by the Office of Religious Affairs in Bandung Kidul Sub-District, Bandung City declared to have no legal force and null and void by law”. What does this mean for about 1 year and 7 months, intercourse between Anjas Suryo and Ms. Dewi Sartika considered adultery?

In fact, it is suspected that the target of Anjas Suryo marries Ms. Dewi Sartika is to get an Electronic ID and Family Card in the city of Bandung has been achieved to streamline business in the field of medical devices.

How dare such is the decision of the marriage cancellation request between Anjas Suryo and Ms. Dewi Sartika to the marriage which has been more than 1 year and 7 months.
