TSH mengatakan bahwa MoU tersebut adalah fakta kerja sama dalam pelaksanaan PKPA calon advokat juga kerja sama dalam bidang penelitian, pengabdian masyarakat serta pendidikan dan pelatihan hukum untuk sertifikat pendamping ijazah.

Penandatanganan MoU juga disaksikan  Wakil Ketua DPD KAI Kaltim Rio Ridhayon Demo, SH, CIL, Wakil Ketua DPD KAI Kaltim Bambang Wijanarko SH, CIL,  Wakil Ketua DPD KAI Kaltim  Roy Yuniarso, SH, CIL, Sekretaris DPD KAI Kaltim Mulyati, SH, MH, CIL, Wakil Sekretaris DPD KAI Kaltim Endang Ariati, SH, CIL,  pengurus DPC KAI Balikpapan Hairul Bidol, SH, CIL,  Dwi Wiharti, SH, MH, CIL, M Rivai, SH, MH, CIL, Yeni Samti, SH, CIL dan advokat KAI KalTim lainnya.

Ketua DPD KAI Kaltim H. Rukhi Santoso, SH, MBA, CIL menambahkan, MoU dicatat dalam lembaran Dewan Pimpinan Pusat KAI nomor : 16/Mou/KAI-UNIBA/VI/2021.

“Ini sesuai dengan pasal 2 ayat 1 UU nomor 18 tahun 2003 tentang Advokat  dan Putusan Mahkamah Konstitusi (MK)  No 95/PUU-XIV/2016,” ujarnya.

Sebelumnya TSH  menegaskan bahwa salah satu tugas organisasi advokat adalah merekrut para advokat  lulusan sarjana yang berlatar belakang pendidikan hukum. “Jadi KAI di Kaltim akan menyelenggarakan kegiatan Pendidikan Khusus Profesi Advokat (PKPA) yang merupakan salah satu syarat untuk menjadi advokat. Yaitu  harus melalui pendidikan kemudian harus melalui ujian. Kalau tidak mengikuti PKPA dan tidak lulus ujian, maka tidak mungkin menjadi advokat,” ujarnya.

Dia mengungkapkan, KAI  Kaltim di bawah kepemimpinan Rukhi Santoso sudah  mempersiapkan untuk merekrut advokat. Hal ini sesuai  pasal 2 ayat 1 UU nomor 18 tahun 2003 tentang Advokat Indonesia, bahwa yang dapat diangkat menjadi advokat adalah sarjana yang berlatar belakang pendidikan tinggi hukum, kemudian mengikuti PKPA yang dilaksanakan oleh organisasi advokat. Ada tambahan di putusan Mahkamah Konstitusi (MK), penyelenggaraan PKPA harus bekerja sama dengan perguruan tinggi. Syarat yang lain di pasal 3 ayat 1 adalah  warga negara Indonesia, bertempat tinggal di Indonesia, bukan PNS, bukan TNI, bukan Polri, bukan pejabat publik, kemudian    ikut magang, tidak diancam pidana di atas 5 tahun penjara serta perilaku jujur dan  baik.

PKPA yang diadakan DPD KAI Kaltim tahun ini diikuti 20 Sarjana Hukum calon advokat muda dari berbagai latar belakang, salah satunya  mantan Kepala Satpol PP Kabupaten Paser Arbain Sihotang SH. BALPOS.COM

KAI Signs MoU with UNIBA

In order to carry out the activities of Special Education for the Advocate Profession (PKPA), the Congress of Indonesian Advocates (KAI) has signed a Memorandum of Understanding (MoU) with the University of Balikpapan (UNIBA). The signing of the cooperation was carried out by the President of KAI Adv H Tjoetjoe Sandjaja Hernanto, SH, MH, CLA, CIL, CLI, CRA (TSH) accompanied by the Chairman of the East Kalimantan DPD KAI, Adv. H. Rukhi Santoso, SH, MBA, CIL, Advisor to DPD KAI East Kalimantan Wamamu, SH, MH, CIL, with UNIBA Chancellor, Dr. Isradi Zainal, ST, MT, SH, MH, MM, DESS, IR. The signing ceremony was held at Hotel Gran Senyiur Balikpapan, Jln. ARS Moh. No. 7, Klandasan Ulu, Balikpapan, East Kalimantan 76114, which was also the location of the PKPA implementation, Friday morning (25/6/2021).

TSH said that the MoU is a fact of cooperation in implementing PKPA for prospective advocates as well as cooperation in the fields of research, community service and legal education and training for certificates accompanying diplomas. Chairman of the East Kalimantan KAI DPD H. Rukhi Santoso, SH, MBA, CIL added, the MoU was recorded in the KAI Central Executive Board sheet number: 16/Mou/KAI-UNIBA/VI/2021. “This is in accordance with Article 2 paragraph 1 of Law No. 18 of 2003 concerning Advocates and the Decision of the Constitutional Court (MK) No. 95/PUU-XIV/2016,” he said.

Previously, TSH emphasized that one of the tasks of the advocate organization was to recruit lawyers with undergraduate degrees with a legal education background. “So, KAI in East Kalimantan will organize Special Education for the Advocate Profession (PKPA) which is one of the requirements to become an advocate. That is, you have to go through education and then you have to go through an exam. If you don’t take PKPA and don’t pass the exam, it’s impossible to become an advocate,” he said. He revealed that KAI East Kalimantan under the leadership of Rukhi Santoso had prepared to recruit advocates.

This is in accordance with Article 2 paragraph 1 of Law Number 18 of 2003 concerning Indonesian Advocates, that those who can be appointed as advocates are graduates with a legal higher education background, then follow the PKPA which is carried out by advocate organizations. There is an addition in the decision of the Constitutional Court (MK), the implementation of PKPA must cooperate with universities. Another requirement in article 3 paragraph 1 is that an Indonesian citizen, residing in Indonesia, not a civil servant, not a military, not a police officer, not a public official, then participates in an internship, is not subject to a sentence of more than 5 years in prison and honest and good behavior.

This year’s PKPA, which was held by the East Kalimantan DPD KAI, was attended by 20 law graduates as young advocates from various backgrounds, one of whom was the former Head of the Paser Regency Satpol PP Arbain Sihotang, SH. BALPOS.COM
