DPP KAI LANTIK & KUKUHKAN 22 ADVOKAT DI WILAYAH HUKUM JAWA BARAT
Bandung, DPP KAI – Dewan Pimpinan Pusat Kongres Advokat Indonesia (DPP KAI) secara resmi melaksanakan pelantikan dan pengukuhan terhadap 22 advokat KAI di Wilayah Hukum Provinsi Jawa Barat, pada hari Kamis 18 November 2021, mulai pukul 09.00 pagi WIB, bertempat di Ruang Maluku, Grand Aquila Hotel, Jln. Dr. Djunjunan No. 116, Sukagalih, Kec. Sukajadi, Kota Bandung, Jawa Barat 40173.
Presiden KAI Tjoetjoe Sandjaja Hernanto, S.H., M.H., CLA., CIL., CLI., CRA (biasa dikenal dengan panggilan akrabnya, TSH) memimpin langsung prosesi pelantikan dan pengukuhan ke-22 advokat baru OA KAI, dalam sambutannya juga turut memperkenalkan para Majelis Sidang Terbuka DPP KAI yang melantik diantaranya Adv. Nasuka Abdul Jamal, S.H., CIL selaku Direktur Keorganisasian, Adv. Aldwin Rahadian, S.H., MAP., CIL selaku Vice President KAI, Plt Ketua DPD KAI Jawa Barat, Adv. H. Thomas Darmawan, S.H., CIL. dan Adv. Deny M. Ramdhany, S.H., C.Me., CPCLE., CLMA selaku Sekretaris Daerah KAI Jawa Barat.
Seperti halnya organisasi advokat lain, Kongres Advokat Indonesia (KAI) mengangkat advokat baru sebagai bagian pelaksanaan UU No.18 Tahun 2003 tentang Advokat. Para advokat baru yang diangkat berlatar belakang dari berbagai kalangan, ada mantan purnawirawan POLRI, pensiunan PNS, wiraswastawan, swasta murni dan lainnya.
“Saudara-Saudara, Anda sudah memenuhi Pasal 2 ayat (1) UU No.18 Tahun 2003 tentang Advokat untuk diangkat menjadi advokat. Semoga Allah SWT, Tuhan Yang Maha Esa memberkati Anda semua,” ujar TSH dalam acara pengangkatan advokat KAI di Bandung, Kamis (18/11/2021).
Pasal 2 ayat (1) UU Advokat menyebutkan, “Yang dapat diangkat sebagai advokat adalah sarjana yang berlatar belakang pendidikan tinggi hukum dan setelah mengikuti pendidikan khusus profesi advokat yang dilaksanakan oleh organisasi advokat dengan keharusan bekerja sama dengan perguruan tinggi yang fakultas hukumnya minimal terakreditasi B atau sekolah tinggi hukum yang minimal terakreditasi B”. Sedangkan pengangkatan dilakukan oleh organisasi advokat berdasarkan Pasal 2 ayat (2) UU Advokat yang menyebutkan, “Pengangkatan advokat dilakukan oleh organisasi advokat”.
TSH melanjutkan pengangkatan advokat ini awal seseorang yang hendak menapaki dunia advokat sebagai profesi officium nobile (mulia) yang memberi jasa hukum di dalam maupun di luar pengadilan setelah menempuh Pendidikan Khusus Profesi Advokat (PKPA) dan Ujiajn Advokat (UKDPA). “Tapi Saudara-Saudara jangan senang dulu. Saudara belum apa-apa tanpa keberadaan klien. Seperti halnya dokter yang tak punya pasien,” ujarnya mengingatkan.
Menapaki profesi advokat, prinsip penting yang harus dilakoni adalah memberikan pelayanan terbaik bagi klien agar nantinya bakal banyak klien yang membutuhkan jasa hukum. Dia pun melanjutkan, “Mari kita hentikan perbincangan terkait Single dan Multi Bar, lebih baik waktu dan energi kita untuk fokus meningkatkan kemahiran, kepedulian dan kesejahteraan anggota” ujar TSH.
TSH memberikan kabar gembira bahwa DPP KAI pada tanggal 12 November 2021 telah menandatangani kerjasama (MoU) terkait Pendidikan Hukum Berkelanjutajn dengan PERADI-SAI dan PERADI-RBA dengan Institute For Criminal Justice Reform (ICJR) yang turut disaksikan oleh Wakil Menteri Hukum dan Hak Asasi Manusia Republik Indonesia, Prof. Dr. Edward Omar Sharif Hiariej, S.H., M.Hum dan Deputy Country Representative for The Asia Foundation Indonesia, Hana A. Satriyo. Pada acara tersebut, diluncurkajn pula Modul Pendidikan Hukum Berkelanjutan di Organisasi Advokat. TSH juga mengusulkan untuk merumuskan kewenangan advokat dalam sistem peradilan maupun di luar peradilan. Menurut TSH, organisasi advokat seharusnya dapat fokus pada persoalan-persoalan terkait resiko advokat dalam menjalankan tugas profesinya, karena advokat juga rentan dikriminalisasi. Bahkan ada aksi-aksi brutal yang membahayakan advokat. Dia memberi contoh, apa yang menimpa Adv. Jurkani yang dibacok oleh beberapa orang tidak di kenal di Kalimantan Selatan sampai meninggal dunia, dimana POLRI seharusnya dapat memberikan perlindungan kepada advokat dalam menjalankan tugas profesi.
Prosesi pelantikan dilaksanakan secara khidmat, tertib, penuh antusias dan dibawah pelaksanaan protokol kesehatan. Dalam kesempatan ini, TSH mengambil sumpah atau janji dan ikrar dari ke-22 advokat baru KAI, serta menyerahkan Surat Keputusan Pengangkatan Advokat dan juga KTA kepada masing-masing advokat. Paska acara prosesi pelantikan, ke-22 advokat ini, mendapatkan ucapan selamat dari para kolega, relasi dan rekan sejawat. Unsur DPP KAI yang turut menyaksikan prosesi pelantikan dan pengukuhan ini adalah Sekretaris Umum, Adv. Ibrahim Massidenreng, S.H., CLA, CIL dan juga beberapa Pengurus DPP KAI lainnya.

President of DPP KAI, Tjoetjoe Sandjaja Hernanto, SH, MH, CLA., CIL., CLI., CRA (commonly known by his nickname, TSH) directly led the procession of the inauguration and the oath of the 22 new KAI advocates, in his speech also introduced the Assembly The Board of Open Trial of newly appointed & inaugurated advocates included Adv. Nasuka Abdul Jamal, S.H., CIL as being a Director of Organization & Membership, Adv. Aldwin Rahadian, S.H., MAP., CIL as being one of Vice Presidents, Temporary Chairman of West Java Chapter, Adv. H. Thomas Darmawan, S.H., CIL. and Adv. Deny M. Ramdhany, S.H., C.Me., CPCLE., CLMA as being Regional Secretary of West Java Chapter.
Like other advocate organizations, the Congress of Indonesian Advocates (KAI) appointed new advocates as part of the implementation of Law No. 18 of 2003 on Advocates. The newly appointed advocates come from various backgrounds, there are former retired POLRI, retired civil servants, entrepreneurs, pure private sector and others.
“Brothers and sisters, you have fulfilled Article 2 paragraph (1) of Law No. 18 of 2003 concerning Advocates to be appointed as advocates. May Allah Subhanawata’ala, God Almighty bless you all,” said KAI President, Tjoetjoe Sandjaja Hernanto at the appointment of KAI advocates in Jakarta, Monday (15/11/2021).
Article 2 paragraph (1) of the Advocates Law states, “Those who can be appointed as advocates are graduates with a legal higher education background and after attending special education for the advocate profession carried out by advocate organizations with the obligation to cooperate with universities whose law faculties are accredited at least B or a law school that is at least accredited B”. While the appointment is carried out by an advocate organization based on Article 2 paragraph (2) of the Advocates Law which states, “The appointment of advocates is carried out by an advocate organization”.
TSH continued that the appointment of an advocate was the beginning of someone who wanted to step into the world of advocate as an officium nobile (noble) profession that provides legal services inside and outside the court after taking the Advocate Profession Special Education (PKPA) and Advocate Examination (UKDPA). “But brothers and sisters, don’t be happy just yet. You are nothing without clients. It’s like a doctor who doesn’t have a patient,” he reminded.
Stepping into the advocate profession, an important principle that must be followed is to provide the best service as possible for clients so that later there will be many clients who need your legal services. He also continued, “Let’s stop talking about Single and Multi Bar, it’s better for our time and energy to focus on improving the skills, care and welfare of advocate members” said TSH.
TSH gave good news that DPP KAI on November 12, 2021 had signed a cooperation (MoU) related to Continuing Legal Education with PERADI-SAI and PERADI-RBA with the Institute for Criminal Justice Reform (ICJR) which was also witnessed by the Deputy Minister of Law and Human Rights Republic of Indonesia, Prof. Dr. Edward Omar Sharif Hiariej, S.H., M.Hum and Deputy Country Representative for The Asia Foundation Indonesia, Hana A. Satriyo. At the event, the Continuing Legal Education Module in Advocates’ Organizations was also launched. TSH also proposes to formulate the authority of advocates in the judicial system and outside the judiciary. According to TSH, advocate organizations should be able to focus on issues related to the risk of advocates in carrying out their professional duties, because advocates are also vulnerable to criminalization. There are even brutal acts that endanger advocates. He gave an example, what happened to Advocate Jurkajni who was hacked by some unknown people in South Kalimantan until he died, where the Indonesian Police (POLRI) should be able to provide protection to advocates in carrying out their professional duties.
The inauguration procession was carried out in a solemn, orderly, enthusiastic manner and under the implementation of health protocols. On this occasion, TSH took an oath or promise and pledged from the 22 new KAI advocates, and submitted a Decision Letter on the Appointment of Advocates and also Advocate Card (KTA) to each advocate. After the inauguration procession, the 22 advocates received congratulations from colleagues, relations and colleagues.
