M. JUNAEDI & MOH. TAMRIN HADIRI SIDANG PERDANA GUGATAN SENGKETA TANAH DI PN CIKARANG

Adv. M. Junaedi, A.Md., S.H., CIL dan Adv. Moh. Tamrin, S.H. dari Kantor Hukum M. Junaedi & Rekan (MJA Law Office), yang berkedudukan di Jln. Dr. Ratna Raya No. 34A, Jatibening, Pondokgede, Kota Bekasi (Gedung 212 – Goro, sebrang RM Kampung Kecil) dan/atau Jln. Garuda 6 Blok H13-15, Rt. 03/024, BGA 2, Sumberjaya, Tambun Selatan, Kabupaten Bekasi, telah menghadiri sidang perdana sengketa tanah di Desa Karanghaur, Kec. Pebayuran dengan nomor perkara : 256/Pdt.G/2020/PN. Ckr pada hari Rabu, tanggal 11 November 2020.

Perkara ini telah didaftarkan dengan judul Gugatan Perbuatan Melawan Hukum ke PN Cikarang, pada tanggal 12 Oktober 2020 berdasarkan Surat Kuasa No. : 01/SK/MJA/IX/2020, tertanggal 30 September 2020, yang bertindak untuk dan atas nama/mewakili para ahli waris dari (Almh.) Djaenah Binti Sudja’i, yang telah meninggal dunia pada hari Sabtu, tanggal 12 Agustus 2017, diantaranya :

  1. Supardi (Suami) selaku Penggugat I.
  2. Saepuloh, S.Pd., (anak) selaku Penggugat II.
  3. Jamil Muslim (anak) selaku Penggugat III.
  4. Siti Nurasiah (anak) selaku Penggugat IV.

Sidang perdana ini dengan agenda mengecek kelengkapan administrasi para pihak, diantaranya Majelis Hakim meminta Para Penggugat untuk memperlihatkan gugatan asli, menunjukkan Kartu Tanda Advokat, Berita Acara Sumpah, baik photocopy maupun keasliannya.

Kemudian sidang dihadiri oleh Kuasa Hukum Tergugat 1, Tergugat 2 dan Tergugat 3. Namun, karena Surat Kuasa mereka belum didaftarkan ke Kepaniteraan Perdata PN Cikarang, maka para Tergugat ini dianggap tidak hadir dalam sidang perdana, mengingat Tergugat 2 tinggal di Jakarta Utara dan Tergugat 3 tinggal di Jakarta Timur, maka Majelis Hakim meminta untuk melanjutkan sidang pada hari Rabu, tanggal 16 Desember 2020.

Turut hadir dalam sidang perdana ini para turut tergugat yakni :

  1. Zean Cornellia, yang merupakan Pembeli tanah a quo dari para ahli waris (Almh.) Djaenah Binti Sudja’i, dalam hal ini selaku Turut Tergugat I.
  2. Kuasa Hukum Camat Kecamatan Pebayuran selaku PPATS, dalam hal ini selaku Turut Tergugat II;
  3. Para Kuasa Hukum yang mewakili Kepala Kantor BPN Kabupaten Bekasi, dalam hal ini selaku Turut Tergugat III;
  4. Kuasa Hukum yang mewakili Kepala Dinas Pendapatan, Pengelolaan Keuangan & Asset [Kantor PBB (Pajak Pemda) Kabupaten Bekasi, dalam hal ini selaku Turut Tergugat IV.
  5. Kepala Desa Karang Haur, dalam hal ini selaku Turut Tergugat V.

Para Penggugat meminta dengan ikhlas kepada para turut tergugat untuk menjadi saksi yang mendukung posita dan petitum dari gugatan a quo, karena kepemilikan tanah telah secara mutlak dikuasai sejak adanya Akta Jual Beli No. 144/V/Kec.Pbyrn/1981, tertanggal 28 September 1981, yang mana (Almh.) Djaenah Binti Sudja’i telah membeli tanah sawah seluas 9.780 M2 dari Para Ahli Waris (Alm.) Wastiri, yang masih hidup saat ini, diantaranya adalah Tergugat I (Janda dari Alm. Wastiri) dan Tergugat II (Anak dari Alm. Wastiri). Sejak saat itu, penguasaan phisik dikuasai oleh para penggugat dan SPPT PBB pun telah berubah ke (Almh.) Djaenah Binti Sudja’i dan dibayar lunas semua pajak PBB sampai detik ini.

Para Penggugat berharap semua pihak legowo, sehingga akan ada solusi melalui jalur mediasi di PN Cikarang, sehingga para pihak akan merasa puas dan menghemat energi, waktu dan biaya.

M. JUNAEDI & MOH. TAMRIN ATTENDS INITIAL TRIAL OF LAND DISPUTE AT PN CIKARANG

Adv. M. Junaedi, A.Md., S.H., CIL and Adv. Moh. Tamrin, S.H. from the Law Office of M. Junaedi & Associates (MJA Law Office), which is domiciled at Jln. Dr. Ratna Raya No. 34A, Jatibening, Pondokgede, Bekasi City (Gedung 212 – Goro, opposite RM Kampung Kecil) and / or Jln. Garuda 6 Blok H13-15, Rt. 03/024, BGA 2, Sumberjaya, South Tambun, Bekasi Regency, has attended the inaugural hearing of land disputes in Karanghaur Village, Kec. Pebayuran with case number: 256 / Pdt.G / 2020 / PN. Ckr on Wednesday, November 11, 2020 at PN Cikarang.

This case was registered under the title Lawsuit against the Law to the Cikarang District Court, on October 12, 2020 based on Power of Attorney No. : 01 / SK / MJA / IX / 2020, dated September 30, 2020, acting for and on behalf of / representing the heirs of (late) Djaenah Binti Sudja’i, who passed away on Saturday, August 12, 2017, namely :

  1. H. Supardi (Husband) as Plaintiff I.
  2. H. Saepuloh, S.Pd., (child) as Plaintiff II.
  3. dr. Jamil Muslim (child) as Plaintiff III.
  4. Siti Nurasiah (child) as Plaintiff IV.

This inaugural session was with the agenda of checking the administrative completeness of the parties, including the Panel of Judges asking the Plaintiffs to show the original lawsuit, showing the Advocate’s Identity Card, the Official Report of the Oath, both photocopy and authenticity.

Then the trial was attended by the Legal Counsel of Defendant 1, Defendant 2 and Defendant 3. However, because their Power of Attorney had not been registered at the Cikarang Civil Registry, these Defendants were deemed not present at the initial trial, considering Defendant 2 lived in North Jakarta and Defendant 3 living in East Jakarta, the Panel of Judges asked to continue the trial on Wednesday, December 16, 2020.

Also attending the inaugural trial were also the defendants, namely:

  1. Mrs. Zean Cornellia, who was the buyer of the a quo land from the heirs (late.) Djaenah Binti Sudja’i, in this case as Co-Defendant I.
  2. Legal Counsel for the District Head of Pebayuran District as PPATS, in this case as Co-Defendant II;
  3. Attorneys representing the Head of the Bekasi Regency BPN Office, in this case as Co-Defendant III;
  4. Attorney representing the Head of the Office of Revenue, Financial Management & Asset [PBB (Regional Government Tax) Bekasi Regency, in this case as Co-Defendant IV.
  5. The Head of Karang Haur Village, in this case as Co-Defendant V.

The Plaintiffs sincerely asked the co-defendants to be witnesses supporting the posita and petitum of the a quo lawsuit, because land ownership has been absolutely controlled since the Sale and Purchase Deed No. 144 / V / Kec.Pbyrn / 1981, dated September 28, 1981, of which (late) Djaenah Binti Sudja’i has purchased 9,780 M2 of paddy land from the Inheritors (late) Wastiri, who are still alive today, including are Defendant I (Widow of the late Wastiri) and Defendant II (Son of the late Wastiri). Since then, physical control has been controlled by the plaintiffs and the SPPT PBB has changed to (Almh.) Djaenah Binti Sudja’i and all PBB taxes have been paid up to this moment.

The Plaintiffs hope that all parties are being wisely and open minded hearts, so that there will be a solution through the mediation channel at the Cikarang District Court, so that the parties will feel satisfied and save energy, time and costs.
